Terms Of Use

Effective date: 12th October 2026

These Terms of Use ("Terms") govern access to and use of the website operated by FMM Consulting LLC ("FMM Consulting," "we," "us," or "our"). By accessing or using the website, you agree to these Terms to the extent permitted by applicable law. If you do not agree, do not use the website. Please also review our Privacy Policy and Website Disclaimer.

1. Website Purpose and Eligibility

The website provides information about our business operations consulting services and allows visitors to contact us or request a consultation. It is intended for adults and individuals authorized to act for their businesses. You must provide information lawfully and must not misrepresent your identity or authority.

2. Permitted and Prohibited Uses

You may browse the website, submit legitimate inquiries, and use publicly available materials for personal or internal business reference, while preserving ownership notices. You must not misuse the website, interfere with its security, impersonate others, submit false or unauthorized information, introduce malicious code, scrape or exploit content without permission, send spam, or upload materials that violate another person's privacy, intellectual-property, or confidentiality rights. We may restrict access where reasonably necessary to protect the website or enforce these Terms.

3. Forms, Questionnaire, and Submissions

The website may include a general contact form, consultation-request form, and a password-protected business and operations questionnaire made available to selected recipients. Submitting a form or questionnaire does not guarantee a response, a consultation, acceptance of a project, or a consulting relationship. You represent that your submissions are accurate to the best of your knowledge and that you have authority to provide them.

Do not submit unnecessary sensitive personal information, account credentials, payment-card or banking information, government identification, medical records, or confidential third-party materials. Supporting documents should be relevant, authorized, and redacted where appropriate. By submitting materials, you permit FMM Consulting to review and use them as reasonably necessary to respond to your inquiry, evaluate a potential engagement, or provide agreed services, subject to our Privacy Policy and any applicable written consulting agreement.

4. Electronic Communications

By communicating or submitting information electronically, you agree that we may respond by email or other electronic means for inquiry- and service-related purposes. This does not by itself constitute consent to receive promotional marketing messages. You are responsible for supplying a working contact email address.

5. Intellectual Property

Website text, branding, graphics, guides, and other original materials are owned by or licensed to FMM Consulting and protected by applicable law. Except for limited personal or internal business reference, you may not republish, sell, distribute, modify, or commercially exploit website materials without prior written authorization. Rights in customized consulting deliverables are governed by the applicable project proposal and consulting agreement.

6. Services and Pricing

Service descriptions, examples, availability, and any prices displayed on the website are informational and may change. No service, deliverable, project fee, or timeline becomes binding merely because it appears on the website or is discussed in an initial inquiry. A consulting engagement is governed by the separate proposal and agreement accepted by the parties. If those documents conflict with these Terms as to a consulting engagement, the accepted consulting agreement controls for that engagement.

7. No Professional Advice or Guaranteed Outcomes

Website content is not legal, tax, accounting, financial, employment-law, cybersecurity, or regulatory-compliance advice. FMM Consulting does not guarantee particular operational or financial results from website information or consulting services. See the Website Disclaimer for further details.

8. Third-Party Websites and Services

The website may include or link to tools and services supplied by third parties, including form and website platforms. Their operation and privacy practices are governed by their own terms and policies. We do not control, endorse, or warrant third-party content or services solely because they are referenced on our website.

9. Website Changes and Availability

We may update, suspend, or discontinue website features or content. We do not guarantee that the website will always be accessible, uninterrupted, secure, accurate, or free of errors. You are responsible for evaluating whether information on the website is suitable for your circumstances.

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SOME EXCLUSIONS MAY NOT APPLY WHERE PROHIBITED BY LAW.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FMM CONSULTING WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING SOLELY FROM WEBSITE ACCESS OR USE. FMM CONSULTING'S TOTAL LIABILITY ARISING SOLELY FROM WEBSITE ACCESS OR USE WILL NOT EXCEED US $100. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED. Claims arising from consulting services, rather than website use alone, are governed by the applicable consulting agreement.

12. Florida Law and Disputes

These Terms are governed by Florida law, without regard to conflict-of-law rules. Before bringing a claim relating solely to website use, the parties will attempt in good faith to resolve the matter through written communication for 30 days after notice, unless urgent relief or a legal deadline requires earlier action. Subject to applicable law and a court's jurisdiction, proceedings relating to these Terms must be brought in the state courts located in Palm Beach County, Florida, or, where federal subject-matter jurisdiction exists, in the United States District Court for the Southern District of Florida. Each party consents to personal jurisdiction and venue in those courts to the extent permitted by law.

13. Updates to These Terms

We may update these Terms as the website, business, or applicable requirements change. The updated version will be posted with a revised effective date. Continued use of the website after an update may constitute acceptance to the extent permitted by applicable law; additional notice or consent will be provided where required.

14. Severability and Waiver

If any provision is unenforceable, the remaining provisions will remain effective to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later.

15. Relationship to Other Documents

These Terms, together with the Website Disclaimer and Privacy Policy, describe the conditions and notices applicable to website use. They do not replace or alter a separately accepted consulting agreement or its project proposal.

16. Contact

Questions about these Terms may be submitted through our website Contact page or by email at hello@fmm-consulting.com.
